Efanz, Inc. (Efanz) developed this Terms of Service in order to help protect Efanz, our Customers and the Internet community from fraud, abuse of resources and irresponsible or illegal activities. As a condition of using the Tabor WiFi Internet Service provided by Efanz, I hereby acknowledge that I have read, understand, and agree to each of the provisions below. I may express my disagreement by not using or subscribing to the Internet access service.

Support

Efanz offers, for paid subscribers, access to free telephone support for the purpose of assisting the connectivity to the network and evaluating issues relating to the service provided. Efanz is not responsible for User’s access device, WLAN settings or VPN configuration, which is under the responsibility of the User.

Suspension or Termination

Any User which Efanz determines to have violated any element of this Terms of Service may be subject to a suspension or termination of service. Efanz will attempt to notify User prior to suspending service (which may be via email or any other notification); provided, however, Efanz may suspend service without notice if Efanz becomes aware of a violation of any applicable law or regulation or activity, including but not limited to a violation that exposes Efanz to criminal or civil liability or that exposes the Efanz network to harm. Such harm to a network includes, but is not limited to, the risk of having an IP address placed on blacklists. Efanz may take such further action as Efanz determines to be appropriate under the circumstances to eliminate or preclude repeat violations, and Efanz shall not be liable for any damages of any nature suffered by any User, or any third party resulting in whole or in part from Efanz’ exercise of its rights under this Terms of Service. The following are violations of Efanz's acceptable use policy:

• Excessive Use - Efanz's Internet access service is intended for periodic, active use of email, news groups, file transfers, chat, gaming, and web browsing. Subscribers agree to use the service on these terms. You may not use the service on an inactive basis to maintain a connection. Pinging to maintain a connection is prohibited. Efanz strictly forbids shared use of an account by those residing outside the residence or whom are not employees of the business. Efanz does not allow hosting of servers or “peer to peer” file sharing on our service.
• Inappropriate Content – Use of the service to transmit, distribute, or store material that, as reasonably determined by Efanz, as inappropriate, obscene (including child pornography), defamatory, libelous, threatening, abusive, hateful or which incites excessive violence is prohibited.
• Harmful Content - Users shall not use the Efanz service to transmit, distribute or store material that may be harmful to or interfere with Efanz’s services or any third party's networks, systems, services, or web sites. Such prohibited harmful content includes, but is not limited to, viruses, worms, or trojan horses.
• Fraudulent Use - Users shall not use the Efanz service to transmit or distribute false, misleading or misrepresented statements, writings or activities or any material containing fraudulent offers for goods or services. In addition, users are prohibited from submitting any false or inaccurate data on any order form, contract or online application, including the fraudulent use of credit cards.
• Unauthorized Access - Unauthorized access (hacking) includes the illegal or unauthorized access to other computers, accounts, or networks; accessing or attempting to access computer resources belonging to another party; attempting to penetrate security measures of other systems; using the Efanz service; Using the services in a manner that encumbers disk space, processors or other system resources beyond amounts allowed; and/or interfering with the service, overloading the service or attempting to disable a host not assigned to User.
• Spamming - The transmitting of unsolicited email to multiple recipients, sending large amounts of email repeatedly that annoys, harasses or threatens another person or entity, or attempts to use Efanz servers as a mail drop or nameserver for SPAM. Sending unsolicited bulk email from another Internet service provider's network advertising or implicating any service hosted or provided by Efanz. The sending of email with added words/characters in an attempt to bypass filters is prohibited.
• Intellectual Property - Material accessible through the Efanz services may be subject to protection under privacy, publicity, or other personal rights and Intellectual Property rights, including but not limited to, copyrights and laws protecting patents, trademarks, trade secrets or other proprietary information. Users shall not use the Efanz Service in any manner that would infringe, dilute, misappropriate, or otherwise violate any such rights.

Payment and Cancellation

All services are contracted on a month-to-month basis unless otherwise specified. Users are responsible for all payment of their services with Efanz until service is cancelled by the User. Users are responsible for payment regardless of account suspension or interruption. Cancellations must be submitted in writing (email notification is acceptable). Efanz does not prorate charges for partial use of the term.

Spam Filtering / Anti-Virus Services Waiver of Damages

In the event that Efanz provides spam filtering and/or anti-virus services, these services are provided "as is" without warranty or conditions of any kind, either express or implied, including, but not limited to, the implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement.

• Spam-filtering Acknowledgements - User acknowledges that no Spam filtering service can eliminate all unsolicited email. User also acknowledges that it is possible for some sites that voluntarily or involuntarily allow Spam to be placed on the MAPS (Mail Abuse Prevention System) RBL (Real-time Blackhole List), resulting in the rejection of email from those sites by Efanz.
• Anti-Virus Acknowledgements - User acknowledges that no anti-virus service can eliminate all viruses. User acknowledges that User may still receive viruses in spite of the best efforts of Efanz. User acknowledges that it is User's responsibility to employ all prudent anti-virus measures, including the operation of fully updated anti-virus software on local computing devices.

User Privacy

Efanz supports our subscribers' right to privacy. We do not share or sell your information to any third-party other than those necessary to provide the service. To review the Efanz Privacy Statement, visit www.efanz.com/privsta.html.

Disclaimer of Damages

Efanz does not accept responsibility for the content of materials and information accessible through Efanz’ services. All persons and organizations, including Efanz subscribers, are solely responsible for all materials published to the Internet. It is the sole responsibility of the persons or organizations who publish information to understand and comply with all applicable laws and regulations.

Efanz’s services are provided on an as available basis only. Efanz, makes no guarantees on any service provided. Efanz, its subsidiaries and employees are not liable for any damages you may suffer as a result of the use of Efanz’s services. Efanz, its subsidiaries and employees are not liable for any loss of profit, opportunity or data which may result from any use, misuse, delay, service interruptions, non-delivery, negligence or errors in use of Efanz's services. Efanz accepts no responsibility for the quality or accuracy of any information obtained using Efanz's services. Users are solely responsible for verifying the quality and accuracy of information they obtain through the service.
